Terms of Service

Last updated: October 11, 2026

These Terms of Service ("Terms") are an agreement between you and Daniel Hariyanto, operating as Caddie ("Caddie", "we", "us", "our") and govern your use of the Caddie iPhone application, WhatsApp assistant, web signup and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old (or 16 in jurisdictions where that is the applicable threshold) and able to form a binding contract under applicable law. By using the Service, you represent that you meet these requirements.

2. Your account

Web signup uses configured Google or Apple sign-in, followed by proof of your direct WhatsApp phone with a fresh one-time code. An email address or sales link alone does not verify you. Additional sign-ins can be linked only from your verified account with another successful sign-in. A changed or recycled number requires reviewed recovery, not a new trial. You are responsible for keeping your channel and account secure. Notify us at hey@heycaddie.app if you suspect unauthorized use.

3. License to use the Service

Subject to these Terms, Caddie grants you a personal, non-exclusive, non-transferable, revocable license to use the Service through the channels made available to you. Apple-device use is also subject to the Apple Media Services Terms and Conditions. You may not sublicense, rent, lease, sell, or otherwise transfer the Service or your account.

4. Subscriptions and billing by purchase channel

Web signup is enabled only on qualified deployments and can remain pending assistant activation. Production signup collects no payment. The separate, explicitly configured Stripe test preview accepts test payment details only; Apple does not manage web billing. App Store purchases remain governed by the offer shown by Apple and Apple's purchase terms.

  • Saved signup. Registration is persistent when this preview is configured. It may remain pending provider, infrastructure and worker authorization. A saved signup does not guarantee activation or immediately usable service.
  • No-card web trial. One eligible trial per verified phone/customer is reserved, not restarted for new emails or sign-in providers. If activation is authorized, it lasts up to 72 hours or 500,000 total input + output tokens, whichever comes first. The clock starts only after the real workspace and enrolled worker are ready. No card is collected and no automatic conversion to a paid subscription occurs.
  • Payment position. Live paid checkout is not offered in this preview. If configured, the optional Stripe test flow after a trial accepts test payment details only. Existing catalog amounts are not an approved live offer. No sales message, signup record or return URL authorizes a charge or paid entitlement.
  • Cancellation. Manage or cancel future web renewals at Web billing through the hosted Stripe portal. For App Store subscriptions, use iOS Settings → [Your Name] → Subscriptions and the deadlines shown by Apple.
  • Refunds. Contact hey@heycaddie.app for web billing/refund requests. Stripe is the processor, not the refund decision-maker. For App Store purchases, use reportaproblem.apple.com; Apple determines those refunds.
  • Prices and tax. Review the selected price and any applicable tax at checkout. Material price changes require advance notice and any consent required by law or the purchase channel.
  • Token allowances. Pro includes 8,000,000 total input + output tokens per month; Max includes 40,000,000. Annual plans have the same monthly allowances. Cached input and reasoning tokens are subsets of input/output, not extra additions. The server reserves each bounded request and settles actual reported usage. Missing usage remains held; reaching the allowance pauses new work rather than creating unapproved charges.
  • Storage allowances. The web offer specifies 4GB for Trial, 16GB for Pro and 64GB for Max. Deployment must enforce the selected storage allowance before production activation.
  • Existing beta accounts. These new-signup limits do not change separately approved legacy beta accounts or their deferred monetary ceiling.
  • Family. The approved family group extends the owner's Caddie and shared subscription allowance; members need no separate signup or subscription. Current verified membership governs access. The group's context remains separate from the owner's private DM, files and history. App Store family sharing is distinct from WhatsApp authorization.

5. Acceptable use

You agree not to:

  • Use the Service for any illegal, harmful, or fraudulent purpose;
  • Instruct Caddie to violate any law or third-party right;
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service or the underlying models;
  • Interfere with or disrupt the Service or its infrastructure, including by transmitting malware or excessive automated requests;
  • Use the Service to generate content that is illegal, defamatory, harassing, infringing, sexually explicit involving minors, or that violates the rights of others;
  • Resell, sublicense, or commercially exploit the Service without our written permission;
  • Use the Service in any manner that violates the Apple Media Services Terms and Conditions or App Store Review Guidelines.

6. Your responsibility for Caddie's actions

The pre-signup sales guide is openly AI and cannot perform customer tasks, run tools, read assistant histories or grant provisioning/billing authority. Once your real assistant is ready, capabilities remain subject to their configured permissions. When you instruct that assistant to take an enabled action — send an email, schedule a meeting, modify a file, post a message, run code, browse a website — you are responsible for that action and its consequences. You should review and confirm sensitive or high-stakes actions before they are executed. Caddie is not liable for the consequences of actions you direct it to take.

7. Your content

You retain ownership of all content you provide to Caddie ("Your Content"), including messages, uploaded files, integration data, and other input. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, and process Your Content solely as necessary to provide the Service to you.

We do not use Your Content to train artificial intelligence models, our own or those of any third party.

8. AI outputs

Caddie's responses are generated by artificial intelligence models. These outputs may contain inaccuracies, errors, or content that is incomplete, misleading, or out of date. You are responsible for reviewing and verifying Caddie's outputs before relying on them, particularly for decisions with legal, financial, medical, employment, safety, or other significant consequences. The Service is not a substitute for professional advice.

9. Intellectual property

The Service, including its software, design, branding, and the underlying technology, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except for the limited license to use the Service described above.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT THE OUTPUTS WILL BE ACCURATE, COMPLETE, OR RELIABLE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CADDIE, ITS OPERATORS, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THAT PERIOD OR (B) FIFTY UNITED STATES DOLLARS ($50 USD).

12. Indemnification

You agree to defend, indemnify, and hold harmless Caddie and its operators from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, your violation of any third-party right, or any action you direct Caddie to take.

13. Termination

You may stop using the Service at any time. Use the app's available account controls or contact support for workspace/account deletion. STOP and FORGET in the sales chat control only sales contact and sales-profile data; they do not cancel subscriptions or delete an assistant workspace. We may suspend or terminate your access if you violate these Terms or if continued use poses a risk to us, our users, or third parties. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and intellectual property) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. You agree to resolve any disputes in the state or federal courts located in San Francisco County, California, and waive any objection to jurisdiction or venue. Nothing in this section prevents you from seeking relief from a small-claims court in your own jurisdiction where applicable.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by in-app notification or email at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Apple-specific terms

The following terms apply only to the Service licensed through the Apple App Store on Apple-branded devices. They do not describe or control hosted Stripe web checkout.

  • Acknowledgment. These Terms are between you and Caddie only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
  • Scope of license. Apple grants you a non-transferable license to use the Service on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
  • Maintenance and support. Caddie is solely responsible for providing maintenance and support for the Service. Apple has no obligation to furnish any maintenance or support services with respect to the Service.
  • Warranty. Caddie is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service.
  • Product claims. Caddie, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including (a) product liability claims; (b) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation.
  • Intellectual property rights. In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, Caddie (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim, to the extent required by these Terms.
  • Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
